Parshas Pinchas: Simechus Rabanim
Eliezer GewirtzmanHostWhat I would like to address today is, we know that there's a musig of smicha in many places.
In Germany, for example, they had two smichas, one which was a real one, and one which was, you know, just lip service because the guy graduated from a medical college.
That was the guy needed a smicha for whatever, so he got a Roch of a Manik.
But on a serious note, what is smicha? How does it really relate to what used to happen b'zman ha-chazal? How do we understand it? And it sheds some light on the sagir.
So, getting back to the smicha that Moshe Rabbeinu, the pastor, saw a smicha, although there are Rishaitim that understand that it was just giving over the malucha, smicha perhaps Yahushua Abed Nun had earlier, but Al-Kopanim, The Gemara in Sanhedrin and Baba Kama is Mavur, that first of all, Smicha was only for Rabbanim in Eretz Yisrael and not in Bava.
And as a general rule, when you look at the Gemara, when someone's just Rav so-and-so, that means that he didn't have Smicha.
Now, once a person has Smicha, so the Gemara is Mavur, that he can Dan... regular mom and childless, knossos, chai v'malkos, chai v'miso, and he could be ma'aba deshonim, be mekadosh dechadoshim.
These are all different things that a person who has smicha had the ability that he was able to do.
Now, the Gemara in HaChoyval and Baba Kamel says that although Dayanin and Hutzlaritz did not have smicha, there's certain things that Dayanin had a right to do, and those things, even today, which the basic rule is, that standard monetary ideas, that people shouldn't be able to steal from one another there has to be some sort of business system in that there should be a recourse for somebody to go if he feels that somebody slighted him in some way Now, as we mentioned, one of the things, one of the primary between today with this and the way it was that they actually had was that the Dayanim were able to be Mekadish al-Pibri'iyah, the Hainu to Aden would come to Bezden, and they would say that they saw the new moon, and they would say Mekadish, Mekadish.
When did that system stop? When was it in Klal Yisrael that that system didn't exist? So we all know that we have a very, a set calendar today written by, that was put together by Hillel, Just to clarify, this is not Hillel that ultimately ended up with Beis Hillel.
