So the Gemara answers that the truth is that in the chararah, there really is a fetus that has been, uh, dissolved.

And still, uh, there is no, no worry, uh, uh, or no consideration of a bechorah on the fetus.

The reason what the, the chachamim instituted to bury it is to prove that there was a baby there.

Just to publicize it that the mother has been exempt now from the bechorah because she already had something born first.

Shall we say that in this chararah there is a complete child? In that case, va'amai ein metamei lo b'magav v'lo b'masa.

Why does he not make oth- others tamei if they touch it or they carry it? But a nefel, a miscarried fetus does make tamei just as a neveilah.

That the reason why it does not defile is because the, uh, fetus that has been dissolved inside in the chararah, um, has been really dissolved in the majority of the blood and the other stuff that comes out of the womb of the mother, and that's why it is batal.

And Rabbi Yochanan goes according to his reasoning, dar amar abi yochanan, Rabbi Yochanan says that Rabbi Eleazar ben Yaakov, Rabbi Shimon amru dover echad.

That Rabbi Eleazar ben Yaakov and Rabbi Shimon said one thing, that the fetus that has been dissolved becomes nullified by the majority.

Rabbi Eleazar ben Yaakov is this that we just said, that we explained the words of Rav Chiya, that the baby that is in the chararah has become nullified in the majority of the blood and the other stuff.

What is the case that Rabbi Shimon says this halacha that the fetus becomes nullified in the majority? The tanan, for we learned in the Mishnah, Mesechta Nida daf chaf bev amud alef, ha'shilya.

The shilya, that is the membrane in which the fetus lies in it, uh, and the woman miscarried, and it is ba'bayis, and it's in the house, but there is no recognizable fetus.

The house becomes tamei, meaning it becomes an ohel hamais, a tent which is hovering over the dead, and it defiles anything that's in the house.

It is because if you have this membrane, then there is no such a thing as a shilya without having first a baby in it.
