Hi, good afternoon, Board of Trustee members, and thank you for this time to present on the current situation of our FCIU physician contract.
I'll also do a quick introduction for Dr. Patricia Fu, who is a primary care physician at AHS, Dr. Melissa Mio, an OBGYN at AHS, and Shane Ruiz, who is our union representative.
AHS is proposing a restriction in the SEIU physician contract that would allow them to unilaterally withhold a COLA if they deem a physician's pay is noncompliant.
No other contract in the system holds this language, including, as far as we know, the executive's language.
In fact, AHS just closed a contract with the UAPD represented doctors, which did not include this language.
The only laws which have been cited by AHS's bargaining team as the reason for this language are the Stark Law and the anti-kickback statute.
These laws do protect patients by ensuring doctors do not receive direct compensation for referrals, which has the potential to incentivize unnecessary care for financial gain.
We are not paid for referrals, nor is our compensation tied to referrals in any way.
Further, the union negotiating process creates a mechanism for AHS to review doctor compensation regularly and to standardize pay by specialty, making kickbacks essentially impossible.
While AHS's bargaining team has admitted that we are not breaking any laws, they have created a second category of concern called noncompliance.
They claim that we are at risk of investigation if any individual doctor is above 15% of fair market value, which is another value determined by these contractors.
The union recognizes that we must do everything we can to mitigate legal liability and cost in this difficult time, and we have been working during this process to do just that.
In the six months that we have been bargaining, HS has not been able to provide a single doctor that is non-compliant.
HS has provided a faulty list, which has failed to adjust for FTE, hours worked, and our administrative time.
Once you adjust for the various issues in these spreadsheets, every doctor is compliant.
physicians made the adjustments and have found that our group is at the 53rd percentile, right in the middle.
Okay, so I just wanted to talk about the consequences of AHS continuing to take this, what I think is unfair labor practice position.
