Bechorot Daf 29A - 29B - 12th Cycle Daf Yomi Shiur (12/13/2011)

We begin today's Daf on Chaf Het Amud Bet, and we are starting from the Mishnah, starting with the words, "Umaaseh bepara." The Sugia that we're involved in is talking about a judge that made a mistake in the Halakha.

People came to him, and he ruled incorrectly.

So we said that whatever he said stays, but he has to pay.

He has to now compensate the side that was wronged.

However, we said that if the judge is a mumche, is a expert, he's the, uh, gadol, so then what he says stays, and he is exempt from, from paying.

So the Mishnah now is gonna bring an example of such cases.

"Umaaseh bepara shenitla haem shenah." There was a story of a para, the cow.

"Nitla haem shenah." The em is like the womb.

It didn't have a womb.

"Vehechilar Rabbi Tarfon lekelevim." So Rabbi Tarfon ruled that the animal is a terefah, and therefore, he fed the animal to the dogs.

So the owner lost money.

Th-the rabbi ruled that it's no good.

It's not kasher.

It's terefah.

Terefah means that the animal has a blemish that is so serious that the animal will not be able to live with such a blemish.

"Uba maaseh et hakhamim beYavne." So the same story came in front of hakhamim in Yavne.

"Vehetzihu ha..." And they said, "Mutak," no problem.

"Sheamar Tudos harofe, ein para bachazirah yotzaa meAlexandriya shel Mitzrayim sheein chodchim haem shela bisvis shelo teled." Tudos harofe said, it was known that from Alexandria in Egypt, they used to export, uh, chazirim, which is a pig, and they al-also used to export these cows.

It seems they're a very special, uh, breed.

So they used to export them, and they used to sell them for a lot of money, and they didn't want anybody to, to breed them themselves.

So what would they do? Before they would sell them, they would take out their wombs, so therefore they could not rep-reproduce.

And Tudos harofe says, "Every animal that comes from Alexandria doesn't have a womb, and it still lives.

So you see it's not a terefah, 'cause if it was a terefah, it would die.

So therefore, the Psak Halakha that you gave, uh, Rabbi Tarfon is wrong." "Amar Rabbi Tarfon..." So Rabbi Tarfon, he heard that.

He said, "Al ka hamorcha Tarfon." Tarfon, there goes your hamor.
