This podcast discusses the attempts by President Trump and other Defendants to recover Attorneys' Fees regarding Fulton County's lawsuit against them. The total amount of Attorneys' Fees is over $16…
Let's discuss how Fulton County's case against President Trump and the other defendants was dismissed.
I've previously discussed this lawsuit in episodes 78 through 82 and episode 98.
The lawsuit against President Trump and the other defendants has been dropped.
The case had been appealed from a lower court decision in which Judge Scott McAfee ruled the district attorney, Fannie Willis's actions, resulted in an appearance of impropriety, and that as a result of this appearance of impropriety, Willis had two choices.
The first option was that Willis and the rest of her office recuse themselves from the case, or second, Special Prosecutor Nathan Wade had to resign from the case.
Trump's legal team, along with those of the other defendants, appealed the Superior Court's ruling.
It was an interlocutory appeal, meaning that it was an appeal of that one issue and that the case had not yet been resolved.
The Court of Appeals that heard the case was a three-judge panel, and they ruled in a two-to-one decision that District Attorney Fonnie Willis and everyone in her office must step down from the case.
District Attorney Fonnie Willis appealed the decision of the Court of Appeals.
Once the ruling of the Court of Appeals became final and District Attorney Willis and her office were dismissed from the case, The Prosecuting Attorneys Council of Georgia was assigned the task of finding another district attorney to handle the case in the place of District Attorney Willis and her office.
This council is composed of six district attorneys and three state court solicitors from around Georgia.
The Prosecuting Attorneys Council tried to appoint another district attorney in Georgia as a prosecutor in the case.
This district attorney would have decided whether to continue the prosecution against President Trump and the other defendants.
However, the prosecuting attorney's counsel was unable to secure another district attorney to handle the case.
The council then appointed its executive director, Peter Skandalakis, to handle the case.
