The legal problems facing David are now expanding well behi- beyond the criminal case against him.

One year to the day, it's been a year to the day since, uh, the dismembered remains of 14-year-old Celeste Rivas Hernandez were discovered inside the singer's Tesla.

Her family has now filed a sweeping wrongful death lawsuit against David, real name David Anthony Burke, as well as members of his family and inner circle.

The civil suit largely tracks the pr- prosecution's theory that David first sexually, uh, uh, assaulted or abused Celeste, because she was only 14 years old at the time.

Um, and then when the secrets of that affair were gonna be exposed, he killed her.

That's the allegation.

Uh, the lawsuit, this new civil lawsuit filed by her family goes considerably further, accusing David's mother, manager, live-in security guard, and others associated with his business operations of knowing, or at the very least having reason to know, what was happening and failing to intervene.

This suit contains 12 causes of actions and seeks contem- compensatory and punitive damages against David and the others, uh, in his inner circle.

I want to talk for a second before we sort of dive deep into the allegations here.

This idea that you can sue, David was an adult, that you can sue his adult parents and others in his entourage for actions that they committed, they committed alone.

There's no allegation here that they kidnapped her, that they-

But can you sue other adults who were in the ambit of David as he's allegedly committing these huge crimes?

You can.

And that, the, the theory they're alleging is that those people had a duty a- and, and that's what you have to prove in a wrongful death lawsuit.

This is a type of civil action.

The burden of proof is much lower than a criminal case, so you have to prove by a preponderance of the evidence.

That's just 51%, that it's more likely than not that, that, uh, they are liable for some aspect of this.

Um, and you know, you can sue a whole bunch of people.

You have to prove that they owed some duty, and if they knew or should have known, is, is, is how it's often put in the, in the language of, of these lawsuits, uh, that David was sexually abusing a minor, that David, uh, was sort of, you know, plotting some sort of, uh, you know, crime against her.

They did maybe have a duty to intervene, and that's what you're gonna have to prove in this lawsuit.

That's where all the action's gonna be.
