Colorado is among the latest states to approve the use of dyed diesel on public roadways, as Governor Jared Polis said.

Polis, a Democrat, says Colorado Department of Public Safety will avoid enforcing the prohibition of dyed diesel fuel on state highways, including initiating inspections, citations, or other enforcement action that until December 31st.

Red dyed diesel is generally exempt from federal highway fuel taxes because it powers equipment used on off public roads, such as farm tractors and construction machinery.

President Donald Trump signed an executive order last week directing the Internal Revenue Service to stop imposing penalties for on-road use of dyed diesel through the end of the year.

Many states, but not all, have followed suit.

Among Polis' other measures, the Colorado Department of Transportation will issue permits allowing truckers to carry more fuel on state highways as long as vehicles comply with all the safety regulations in an effort to lower the cost of delivery of gas and diesel.

The State Department of Public Health and Environment will submit a request to the Environmental Protection Agency to waive reformulated gas requirements during summer 2027 that increase supply and lower the cost of gas.
