Number two, the seller could give notice to the buyer that they intend to terminate due to their failure.

Now, if they did that, the contract then and it still will say that the buyer then has five additional days to get that approval completed.

or then the seller will terminate the contract.

And then the third option that they had previously, and they still have this option, is to terminate the contract and receive the earnest money, and then the seller also could seek any additional remedies the contract affords them due to breach.

So those three clauses were in the contract, and they remain in the contract.
