the whether or not the player who has been it's been said that you know was desperate to play was coerced on the face of it it seems very much as if he was not because he openly agreed that he wanted to and he signed it what do you where are your fears coming from then
10:29
yeah the independent findings from king's council say that he wasn't coerced i think that's That is a very narrow reading of coercion.
10:41
There was nothing explicitly coercive, but you have to understand the context for these players who on average play 60 games and who generally have, you know, poor to middling prospects in terms of employability after the ends of their careers.
11:00
The option... which is given to these players, is often, well, you sign this or you agree to this.
11:09
You conduct yourself in this way or you don't play again.
11:12
You don't play for our club.
11:13
We saw that with the Essendon saga.
13:36
What do you think should be happening from here, Nick, in that respect to stop this happening again?
4:06
We'll get to a lot of legal problems that this case has uncovered, but what would you have to say about the privacy concerns for this player?
4:18
Well, it comes at an interesting moment.
4:21
There are so many legal issues that have come up with the way that this issue has been handled by Geelong and the AFL.
4:29
But for the player, it does appear to me that there's been a breach of his private medical information and we're understanding more about the impact that all of that, that being outed has had on him personally.
4:43
Interestingly, from June last year, there was the implementation of a new statutory right to bring a claim for damages for a serious breach of privacy, which we previously hadn't had in Australia in that kind of formulation.
5:02
And it deals with disclosure of information that you would expect would be kept private um fault or just sort of a deliberate action by someone else to leak information like medical information and seriousness that is is this more than a trivial or a minor you know breach of what what information you might um expect to be private look to be clear i don't i don't represent um the the player but I would think that from an arm's length view this potentially meets all of those criteria and there is potentially a claim for damages here for the breach of his private medical information which is a very serious matter and is clearly having an impact on the player.
10:39
But is there, do you believe that there should be, what do you think of that process really and how much wider it should be?
10:47
Well, I think this is a rolling saga in many respects.
