Kylie Kilgour: Acting Commissioner of the National Anti-Corruption Commission

... where if they come across something happening in their agency and they are of the belief, and it just needs to be a belief, um, that they've got something happening that it might be serious or systemic corruption, they have to send that to us, and that's a mandatory requirement under Section 33 of the NACC Act.
K

We have an assessments team, um, a small branch of about 40 staff who manage the intake of all of those referrals, and then they go through what we call an, first of all just an intake and triage process, which is just to work out are we in jurisdiction, because unfortunately some people do send us referrals that are about things that are about states and territories- Um, or they're just not corrupt conduct, they're really kind of complaints about they don't like how a government agency decided something.
K

Sometimes they don't like how a court decided something, and they'd like us to review that decision.

So we knock quite a lot of matters out, and again, that's very similar across all the anti-corruption commissions, that probably about 90% of the referrals you get, you're not gonna do anything with them.

For the 10% that do proceed through to, you know, we think that, well, A, we've definitely got jurisdiction, and B, uh, it looks like what the person is reporting to us is quite credible and it fits within the definition of corrupt conduct, that will go through a more intense assessment process by, um, slightly more experienced and senior assessment officers.
K

Uh, there'll be legal advice given as well if there's any tricky sort of jurisdictional issues.
