Tell us, Jay, what are we looking to do here with this lawsuit that David filed?

for the opportunity to provide commentary and my thoughts on some of the claims that he needed to make to distinguish this lawsuit from the others.

And the thrust of my point, and only gonna talk about my part, was that the entire picture of what's really happening here has not been really ever addressed.

The Sky Marketing decision addressed only whether or not the commissioner executive commissioner had the authority to do what she did under the statute and the supreme court said it did and so none of the claims the merits of that case were ever touched Additionally, there is a reason that the hemp industry is being massacred like this, and that is to create a new class of monopoly.

David and I, over the course of maybe the last year, have been talking about Texas's constitutional prohibition on monopolies, which it's not been talked about in court yet.

I think it's one of ten arguments that he's got to make.

The size of the complaint that was filed today is significantly larger than the one that I reviewed just a few days ago.

Uh, Jay, Brian, I'm gonna let go to you guys first on this, but Jay, can you just set us up here a little bit with what happened here Monday?

So the lawsuit brought by, um, the group of companies that are now the plaintiffs for Andrea Steele, the attorney who has worked with HBC and Hometown Hero for years, and I don't know if this is an HBC suit or, or how that, how that works.

I haven't been able to speak with Andrea.

But, uh, she filed a, a lawsuit in Galveston, her client is headquartered there, and, uh, asked for emergency relief.

The judge denied it, saying that she didn't meet the, the, the test for any of the claims that she made, did not have any likelihood of success, uh, in the arguments that she's gonna make.

And so I know that it's a two-page, very simple, um, denial.

Basically, her client was claiming, um, unconstitutional restraint on, uh, the commerce commi- uh, commerce clause because they, they ship, uh, hemp products, but it's the trans-shipment through Texas that is the que- was the question, I, I think, if I understood this right.

But isn't THCA affected by this?

Yes.

THCA is banned under the permanent rule adopted by dishes.

So it's not banned by the sky marketing decision.

It's banned by the permanent rule.

And and that is that is troublesome.

I don't believe, though, that it is not on schedule one of the controlled substances list.
