The Director of Public Prosecutions intervenes in this appeal to advance two submissions.

Our first submission is that the standard mens rea jury instruction for in sexual assault cases leads juries astray.

by allowing myths and stereotypes to creep into the deliberation process.

Courts of appeal have signaled the alarm as have academic commentators.

This case provides this court with an opportunity to do the same.

I put to you that given the evidence, you will have little difficulty in making a decision on this element of the offense.
