So when you talk about your four-step process, which is very prescriptive, whilst ours is an equal division, what we are doing at the commencement, I always say, is a simple four-step process as well because we're identifying all the assets and liabilities in the same way that you are.

We're then classifying those as either they're going to be separate property, not shared equally, or relationship property, divided equally.

We then value everything and then we divide it and we're just dividing the relationship property.

Once that division has occurred, the courts then take a step back and say, is it equitable in so much as is there one party who has, because of the division of functions in the marriage or the de facto relationship, the income and living standards of the other is significantly higher.

There's an assessment then on the other parties, on the gap between their earnings and So if one person's eating you know, 500,000 and the other has been out of the workforce for years, bringing up the children and has very low, little earning potential.
