So why do you think the president is already talking about an appeal before the judge has even heard the arguments? With me now to break down the legal and constitutional stakes of this historic lawsuit are trial attorney Ken Turkel and the president and CEO of the Foundation for Individual Rights and Expression, Greg Lukianoff.

His nonprofit organization has spent years fighting speech, crackdowns from both the political left and the right.

Ken, I'll begin with you here because we know the media's argument is rooted in the First Amendment, rooted in due process.

But even those who don't, as Roe did, echo Hamas propaganda, are slamming Kraft.

According to Greg Lukianoff of the Foundation for Individual Rights and Expression, or FIRE, Kraft was within his rights to say that Macklemore or anyone else couldn't use his stadium to voice opinions he didn't like, but he told CNN that doing so helps foster a culture in which free speech can flourish.

Luganov was a stern critic of left-wing council culture that resulted in the deplatforming of conservatives during the heyday of the Black Lives Matter movement.

But since the start of the surge of anti-Semitism that followed the Hamas-led Palestinian Arab terror attacks on Israel on October 7, 2023, he's used the same argument to speak up in defense of pro-Hamas mobs on college campuses, even when Jews are targeted by them.

In the past 20 minutes or so, we've heard from at least four of the leading press freedom and free speech groups in the country, all speaking out, all very concerned about the prospect that the president's words will be turned into actions.

I'll give an example from the Foundation for Individual Rights and Expression saying, when the White House opens its doors to the press, it must comply with the First Amendment.

He can't ban outlets from the White House just because he doesn't like their reporting or commentary.

And here's the Freedom of the Press Foundation, Seth Stern.

That right there is Connor Fitzpatrick.

If you don't know who he is, he runs FIRE.

FIRE, who, by the way, has taken on a lot of the left-leaning insanity in colleges, and it's about freedom.

And if we don't have freedom of press, guess what? They can get away with anything they want, which is what they're pretty much trying to do anyways.

But we need freedom of press.

And that's where we begin.

I'm joined now by Connor Fitzpatrick, an attorney for FIRE, the Foundation for Individual Rights and Expression, an organization that has consistently defended attacks on free speech from both the left and the right.

Is this going to fly? Is this ban on these press organizations going to fly?

For those who are watching today who maybe don't have a lot of sympathy for the organizations that have been kicked out, I would ask, think about a future Democratic administration.

Ask yourself if you would be okay with them kicking out Fox News or Newsmax or the Wall Street Journal.

In 1977, in a case called Sherrill v. Knight, the courts held that the White House cannot exclude reporters simply because they don't like their reporting.

That has been the law for Democratic presidents.
