But U.S. District Judge Reed O'Connor in Fort Worth ruled on Monday, this last Monday, that the 2022 rule violates the right to keep and bear arms under the U.S. Constitution's Second Amendment and is too vague to satisfy the Fifth Amendment's due process guarantees.
News outlets are saying that Supreme Court upheld Biden's rules last year in the Vanderstock case, which we talked about, but that interpretation that you're seeing all over the media is wrong.
Supreme Court found in 2025 that ATF's interpretation could fit within the GCA's definition of firearm, but the Supreme Court did not find that the rule was constitutional.
Those are two different things, right? It was a procedural question that they decided, not a two-way question.
