Section 19, carrying firearms in a public place.
Section 19 of the Firearms Act 1968 creates the offense of carrying firearms in a public place without lawful authority or reasonable excuse.
The offense is designed to protect public safety by restricting the presence of firearms and imitation firearms in locations accessible to the public.
Unlike some other firearms offenses, the prosecution does not need to prove any intention to use the weapon unlawfully.
The focus is simply on whether the person had the firearm with them in a public place, and whether they can demonstrate a lawful authority or reasonable excuse for doing so.
This section applies to several categories of weapons.
These include air weapons, whether loaded or unloaded, other firearms, together with suitable ammunition, whether loaded or unloaded, and imitation firearms.
Possession of a shotgun is also covered by Section 19.
However, unlike the other type of weapons, these must be loaded to commit the offense.
