Previously, poisoning offences were covered under Sections 22, 23, and 24 of the Offences Against the Person Act 1861, and each offence considered the types of substance used and the level of harm caused.
Section 22 covered offences using chloroform or other stupefying drugs in order to facilitate an indictable offence.
In essence, it targeted the use of sedatives or intoxicants to incapacitate victims before committing another crime.
Section 23 made it an offence to unlawfully and maliciously administer a poison or other destructive or noxious thing to endanger life or cause or intend to cause GBH.
Alongside this, Section 24 covered lower level poisoning offences, with a person committing this if they unlawfully and maliciously administered a poison or other destructive or noxious thing with the intent to injure, aggrieve, or annoy.
