In United States v. Armstrong, in 1996, defendants argued they were being selectively prosecuted on the basis of race.

The court set the bar for even getting discovery on that claim so high that it had been described as nearly impossible to meet.

So we have a power that is vast, unreviewable, and when challenged, nearly impossible to examine.
