Texas Attorney General Ken Paxton wasn't playing the usual D.C. good old boy political theater when he hauled Black Rock, State Street, and Vanguard into federal court in the Eastern District of Texas.

There was a suit filed Wednesday in federal court for the Eastern District of Texas accusing C.H. Robinson and TQL of having engaged in a pattern of racketeering activity predicated on forced labor and wired fraud from which they knowingly derive a substantial financial benefit that is the definition of rico all right so the lawsuit was brought by six carriers stevens trucking western flyer express dnm carriers ray miller trucking iwx motor freight christensen transportation inc and eos inc all right the suit brings up a separate question How many of these suits are brokers going to face? This is nuts, all right? And according to a lengthy statement from C.H.

Robinson, they said, we reject the allegations in this civil suit.

It's false characterization of C.H. Robinson in our business practices, and it's fundamental inaccuracies about how the freight market actually works.

So that doesn't help the defense.

It helps the plaintiff.

And the plaintiffs got really, really—Nyx Patterson is well, well known in the Eastern District of Texas.

So they got a great plaintiff.

Um, there are certain jurisdictions that are much more friendly to patentees.

For many years, they were litigating in the, um, uh, Eastern District of Texas because the juries tended to be very pro-patent and would uphold them all the time.

Um, in the Ninth Circuit, years ago, I think back in the, I think it was in the late '70s, um, one of the judges said, "The only valid patent is one that this court has yet to get its hands on." So it was notorious for just holding patents to be invalid.

That's changed a bit since, you know, Northern California has kind of become a major tech hub, and so a lot more patents have, are upheld there now than used to be.

This also means that to the extent you can transfer your case out of Rocket Docket Districts, to districts where the trial dates are set three years out, which would be way longer than the IPR timeline, the better off you are.

So that means getting out of the Eastern District of Texas or the Western District of Texas or the Eastern District of Virginia, those districts that set trial dates very, very fast.

If you're in one of those, if your case remains in one of those districts, it's going to be almost impossible to have your IPR instituted under the current regime.

You have to think about, given the current settled expectations doctrine that's been expressed by the PTO, whether it's even worth bringing an IPR challenge to older pets, because there's a very high likelihood it will be denied, no matter how quickly you file that petition.

So when Rare Breed made their settlement agreement with the ATF DOJ, specifically the DOJ, part of that agreement says that FRTs are qualified as this.

And that's using the Eastern District of Texas as ruling on what FRTs are, which is it has, I think, five different functions that are required.

Things like it has to be held out.

held in the safe position while it's outside of battery and so on and so forth.

So somebody is going to have to fight that case.

I don't know who it will be, because there's a lot of people that sell handgun FRTs at this point.

I think they would have very solid ground because of the settlement agreement that has been made and the Eastern District of Texas ruling that says FRTs are okay.

Their only hassle is going to be proving that it is an FRT by the definition that was made in Texas.
