United States Court of Appeals for the District of Columbia Circuit

Okay, we are less than two months away from the midterms, which is why I don't think that the Supreme Court is going to let Trump blow up mail-in balloting, although as of this recording, the justices have not issued a ruling.

But the DC Circuit did weigh in, and once again, the appeals court refused to stay the trial judge's order.

Right.

We have talked about this case more or less, uh, on every show for the last month.

At Yale Law School, he served as the senior editor of the Yale Law Journal.

He subsequently clerked for Judge Lawrence Silberman at the U.S. Court of Appeals for the District of Columbia Circuit and for Justice Clarence Thomas at the U.S. Supreme Court.

He filed an amicus brief on behalf of himself in this case.

Well, I think you said that the DC Circuit will be reversed on standing grounds.

Yes, I said, I don't think-

Uh, which does not seem obvious to me, but if that's what everyone thinks, I assume they're right.

[laughs] Um, uh, I listened to the entire, uh, DC Circuit oral argument in this case because there's a, another podcast, uh, called Audio Arguendo, where, um, uh, somebody just, like, uploads cool Courts of Appeals arguments about, like, contested cases with, like, no explanation.

It just, like-- So it just, like, pops up in your feed, and so, like, I just started listening to it.

The ballroom, the top, is an integral part of the entire security structure.

On April 17th, the United States Court of Appeals for the District of Columbia stayed the district court's injunction, effectively allowing construction to proceed while it considered the government's appeal.

Then on August 7th, the Court of Appeals resolved that appeal and upheld the injunction.

So the injunction's back in effect.

He kept it at eight for an entire year in order to get to the next administration so they could put Justice Gorsuch in instead of my constituent, Merrick Garland, who was one of the most talented people ever nominated to the Supreme Court.

He was the chief judge of the DC Circuit and they kept him off.

So eight was fine with them now.

Now they want to go to nine because President Trump likes it just fine.

And that, the challenge got filed in the Court of Appeals.

I don't think they're required to go the D.C. circuit.

I am your host Shad Dales and let's head straight to Washington D.C. where opponents of cannabis rescheduling have just suffered another major setback in federal court.

So this story was first reported by Marijuana Moment where the U.S. Court of Appeals for the District of Columbia has rejected an attempt to immediately block the Trump administration from moving forward with federal cannabis rescheduling.

Well, well, well.

Does that surprise you? The narrative is becoming more and more clear as to why, yes, we think, and I think, that cannabis rescheduling is just around the corner.

The second emergency appeal was filed by the DHS on Tuesday.

It asked the Supreme Court to set aside a ruling the previous Friday by a divided panel of the U.S. Court of Appeals for the District of Columbia Circuit, keeping in place a temporary freeze on a new federal database of voter information stemming from an executive order signed by Trump in March of 2025.

The appeals court ruled that the database could violate laws shielding Social Security information.

The Supreme Court gave the challengers until September 15th to respond to the Trump administration request.
