Shane A. Pennington

It's not going to be FDA approved.

Evidently, according to administrative lawyer Shane Pennington, many Schedule III drugs are not FDA approved.

Some steroids, for example.

You know, part of the problem is there's no one showing up to the steps.

And so I started my career working, uh, for Christian, Brian, uh, Charlie, Sean, uh, And then a whole bunch of others who were a part of it, but those were kind of the main four partners when I was there.

And then for part of that time, I got to work directly in a practice group where it was Christian Sederberg as the partner, Shane Pennington as the senior, and I was the junior, which was one of the best experiences I've ever had.

And I mean, continues.

Shane and Christian are both mentors to me.

I know that you are interested in this conceptually based on the organization that you founded, Project for 2029.

And I'd love it if you could just give us some ideas of what else could be done via executive order for cannabis policy and progress that the industry should be rallying behind.

Yeah, so I, along with Shane Pennington, again, have been screaming about 811D1 for years and all of the cannabis organizations pretty much told us to shut up.

And so I'm happy that they actually used it.

You bet.

So I'm so glad you asked because, uh, now I get to introduce you to, uh, my good friend, uh, Shane Pennington.

Uh, he's, uh, a colleague of mine, a brilliant lawyer, uh, writes prolifically, uh, in this space.

And, uh, uh, w- when this, uh, first round of the DEA, uh, hearing had gotten underway, uh, Shane Pennington came along to take it right off the rails.

[laughs] And, uh, he challenged, uh, uh, the, the hearing and, and how, uh, uh, the, the hearing had, uh, come, come together.

Um, he filed a 57-page motion, uh, to s- to disqualify the DEA as the proponent, arguing that the DEA had signaled it opposed its own rule and couldn't carry the burden, alleging improper contacts with opponents.

Um, you know, I [laughs] I, I think there are a lot of people reading from that, oh, doom and gloom.

I, I, you know, I don't know is the answer.
