what's up everyone and welcome back to the program when it comes to the murders in moscow we know the who but we still don't know the why and unfortunately we might not ever know and that's because brian kolberger accepted that plea deal that was offered by the state after his team approached the state looking to make a deal and like i've said before while i understand why they would make that deal I don't think that it was the right way to go.

And that's because I think they had enough evidence to get the job done when it comes to the prosecution.

But when you're talking about a lengthy trial like this and you're talking about a situation that has to do with capital punishment, a lot of things can go wrong with your prosecution, right? All it takes is one little slip up.

Why these kids? What motivated you to choose these people as your targets? What would motivate somebody to pick these four kids out and then go and murder them while they're sleeping? And I think that's a question that all of us have.

Unfortunately, I just don't think we're ever going to have any answers unless bitch-ass Brian Kohlberger decides he wants to talk at some point, grant an interview, write a book, whatever.

But the truth is, he should be forced to tell everybody what the motive was as part of the plea deal.

That's a no-brainer to me.

We're just going to let him get up there and say, yes, I did it, but not give us any of the answers that the families deserve.

Yeah

... into that, but, but you just need to understand that, um, there is a question right now with respect to w- plea bargains and what has to be disclosed.

Now, I will say this.

I always felt comfortable about it because, again, as, as I said, I was operating in a jurisdiction where the d- district attorneys, all the ones I dealt with, had an open file policy.

They are essentially saying look we have the DNA we can put you at the scene if you force us to go to trial we will roll the dice and try to lock you away forever They use the terror of that Maximum charge to bring the defense to the negotiating table Exactly because taking a nineteen eighty three Cold Case to a jury trial in Twenty Twenty Six is terrifying for both sides Right the prosecutor knows their Witnesses are dead or have faded memories And the defense Knows Modern juries treat DNA evidence as absolute gospel It's a Highwire act when neither side wants a fall Exactly the desire for dramatic cinematic courtroom Justice where the killer breaks down on the stand and confesses crying That is incredibly rare It's just TV The reality of the criminal justice system is deeply pragmatic.

It is built on risk assessment,.the Prosecution trades theoretical severity of a murder conviction For the absolute certainty of a guilty plea Which brings us to the climax of this report in twenty twenty six the culmination of this entire four decade Saga is the plea deal The pragmatism of Justice in action Right the text states that at Age Seventy Three Marcus sanfratello pleads guilty but he does not plead to second-degree murder he pleads guilty to a lesser Charge of First Degree manslaughter A significant step down And the Judge sentences him to twenty Years in prison With a mandatory minimum of ten Year serve Now This Is Where we need to heavily scrutinize the public framing of this deal Oh please do because it makes me so mad The AP Report quotes San frittella as defense Attorney Elizabeth Baker she provides a written statement Saying Her Client had quote Strong motivation to resolve the matter due to a recently diagnosed complex health issue.

Ah.

She goes on to note that this plea gives the victim's family closure while allowing San Fratello to get the medical treatment he urgently requires while serving his sentence.

And the third force.

And finally, you have the inevitable decay of human biology.

Sam Fratello's failing health became the final catalyst that pushed his defense team to accept a plea deal.

It's an incredible summation Science eventually caught him, but his own failing biology negotiated the surrender.

Both Kenny's family and the Obamsele family were present in court, two separate families that have been absolutely devastated by the same tragic crime.

The families didn't interact or acknowledge each other as the judge read out the plea deal that was being offered.

Courtney herself remained pretty unemotional in court.

There were no tears or anything like that from her.

that had already been agreed by both sides when reaching a deal that worked for everyone.

So the agreement stipulated that if Courtney pled guilty to the one count of manslaughter with a deadly weapon, she would be sentenced to six years in prison with time served, followed by five years of probation.

Courtney officially accepted the plea deal, effectively agreeing to plead guilty to Manslaughter with a deadly weapon, as agreed.

And she is handed down her sentence by the judge and receives the six years in prison and the five years probation when she's released.

A mystery plea deal gone down with OnlyFans star Courtney Clenney in the murder of her live-in boyfriend, Christian Obumseli.

On November 6th, Chris pleaded guilty to all nine counts against him, including the murders of Shanann, Bella, and CeCe.

At that point, he still hadn't confessed to killing his daughters, but pleading guilty to every count was part of the agreement with prosecutors, who agreed not to pursue the death penalty if he consented to all charges.
