The Fife nurse has brought the legal case against her own union over what she claims was direct discrimination because of her gender-critical beliefs.
speaker_3NARRATOR
70:30
Ms Peggy originally brought a case against NHS Fife after sharing a changing room with the transgender medic Dr Beth Upton at Kirkcaldy's Victoria Hospital in December 2023.
speaker_3NARRATOR
70:43
The Employment Tribunal upheld her claims of harassment against her employer, but dismissed allegations of discrimination, indirect discrimination and victimisation, along with all allegations made against the trans doctor Upton.

70:58
During the hearing, it was revealed that Ms Peggy has shared racist jokes, including mocking the victims of floods that killed thousands in 2022 in Pakistan, by saying that the country would look like a bowl of Cocoa Pops.

71:13
Other messages shared by Ms Peggy to a group chat said, I bet little Mohammed isn't having to walk three miles to fetch water now.
speaker_3NARRATOR
71:22
Now, Ms Peggy has brought forward a legal case against the Royal College of Nursing over the support it offered during the dispute with NHS Fife.
speaker_3NARRATOR
71:31
Ms Peggy's team is expected to claim that the Royal College of Nursing failed to advise her in January 2024, after her suspension from NHS Fife, that she had a legal claim against her employer.
speaker_3NARRATOR
71:43
The nurses' case also claims that the union refused her request for legal support in January 2025, during Fife Health Board's handling of her disciplinary investigation.
Martin GeisslerHOST
2:40
That hears a lot of evidence, and almost two years after the original incident in December last year, December 2025, it comes back with a ruling.
Martin GeisslerHOST
2:50
It rules that NHS Fife had harassed Sandy Peggy via four procedural failings, but Sandy Peggy's main claims that she was victimized and discriminated against were dismissed.
Martin GeisslerHOST
3:07
After that verdict is delivered, she holds a press conference and she says, "This isn't the last you've heard of this.
Martin GeisslerHOST

I'm taking this to appeal."

Back-- Am I right in saying back in the same room, in the same hearing center, in, in a tribunal hearing center in Dundee?
Lorna GordonCORRESPONDENT
4:53
Yep.
Lorna GordonCORRESPONDENT
4:53
Same city, same building, same room, uh, that, uh, the original tribunal, the first tribunal against, uh, NHS Fife took place.
Lorna GordonCORRESPONDENT
5:05
Uh, I'm thinking back to it.

78:42
The outcome of Sandy Peggy's employment tribunal against the Royal College of Nursing, the RCN, could redefine what workers can expect from their trade unions.
KarenNARRATOR
78:59
Nine months ago, a tribunal ruled that NHS Fife had harassed Ms Peggy on four counts after she objected to sharing a changing room with transgender medic Dr Beth Upton at Victoria Hospital in Kirkcaldy on Christmas Eve 2023.
KarenNARRATOR
79:24
That dispute is not settled.
KarenNARRATOR

KarenNARRATOR

KarenNARRATOR

At a seven-day hearing in Dundee, overseen by employment judge Melanie Sangster, Ms. Peggy will claim the trade union refused her legal report after she was suspended by NHS Fife.
KarenNARRATOR
80:14
The, the fifty-two-year-old nurse argues that decision was discriminatory based on her gender-critical beliefs.

What am I thinking about? It was, it was, it was last year.
speaker_0HOST
1:15
Um, uh, Sandy Peggy sued her employer, NHS Fife, for discrimination and harassment arising out of, um, the treatment that, um, she had suffered resulting from a, a, a policy that NHS Fife had of permitting, um, biologically male people to access, uh, women-only or female-only, um, changing facilities.
speaker_0HOST
1:42
Um, this, this hearing, as you're aware, um, con- continued over the course of last year, and we got judgment towards the end of, um, towards the end of last year or the start of, the start of this year.
speaker_0HOST
2:00
Um, and, and I suppose the thing that we need to be kind of thinking about in terms of what this case is about is that, um, the first case, the first Peggy case, um, pertained to, uh, detriments that she will have suffered, um, up to a particular date.
speaker_0HOST
2:17
And then, um, other detriments that she might have suffered after that date, um, had to be or will have to be addressed in a, in a separate set of cases or a separate case that Sandy Peggy is taking against, um, NHS Fife.
speaker_0HOST
2:33
So the stuff that we've dealt with so far are the detriments that arise, um, in and around the claims, um, particularly up to the, um, the changing room policy, the incident in, um, the changing room with Dr. Upton in, you know, on Christmas Eve of twenty twenty-three, and then, um, the investigation of Sandy Peggy, um, for misconduct, her suspension, all of that stuff.
speaker_0HOST
3:01
But of course, Sandy Peggy has been dealing with NHS Fife beyond that, so there was the continuation of the, um, the investigation and certain detriments that may have arisen as a result of either information that only came to light because of a, a late in the day disclosure from, um, NHS Fife that hadn't been disclosed up until the point that the tribunal started, so there was no point that Sandy Peggy would have been able to bring claims about that behavior or, um, the conduct of NHS Fife during the course of the, the previous, uh, case.
speaker_0HOST
3:42
Um, and I'm thinking in particular here about the statement that NHS Fife made, um, effectively taking aim at Sandy Peggy and her legal team for bringing the case and, um, implying that they were responsible for some of the, um, distress that, uh, people in N- in NHS Fife had been experiencing as a result of kind of media attention, um, that the case was bringing.

Can I thank the First Minister for his response? Elizabeth feels failed by NHS Fife and NHS Tayside, and it's left a devastating and lasting impact on her and her family.
