Why this is so important is that he has now been asked to provide clarity, at the very least, by the Madlanga Commission.

That's the breaking news.

The Madlanga Commission wants to know some answers to some questions.

And we don't know exactly what the nature of those questions will be right now.

But what we got there from Ule Letriti-Jones echoes something that has also been said by investigative journalist Mutibe Mutiba, who's also been on this channel.

His legal woes are now piling up.

But you'll definitely recognize him because he's been evading his appearance at the Madlanga Commission.

He's been to court.

He apparently had a doctor's note.

And then with him then returning to the office, you know, the cloud of criminal charges now away from him, it means that we might see a police commissioner actually finishing his term with somewhat of a clean slate.

But Nandi, at the same time, he is still under scrutiny.

A lot of the allegations we see at the Madlanga Commission relate to alleged criminal infiltration of the police that happened, not just before his term in office, but also during.

And that's specifically regarding the PKTT disbandment order, which he said he had to follow because it was a request from the police minister at the time.

It literally says- a roadmap for preventing this kind of, um, litigation from stopping cases from proceeding.

And the other thing that I will say, which I think we cannot lose sight of in this moment, is that the fundamental legacy of the Mdlalonga Commission has been that the DCJ, Mbuyiseli Madlanga, has concretely smashed the notion of style and grad litigation being an effective mechanism to avoid accountability because he has refused over and over and over again to allow court applications, postponements, et cetera, et cetera, to stop his commission from getting to the truth.

And he's actually come out and said, judges need to be more courageous in saying, "Is this an abusive process that's being utilized to evade accountability?" And if that is the case, they need to get up and say, "No, no, we're not doing that." And that is what Nkosinathi Chili has done, but he's done so in the, in, in the shadow of what, um, the DCJ has done with the commission.

And that's why I think South Africans have responded so powerfully to it because we're seeing a legal mechanism of accountability that's not being delayed, that's not being subverted, and that is not being held hostage by futile legal challenges.

Look, this commission, unlike all the other commissions that came before it, including the Zonda Commission, has created a lot of excitement, but positive, you know, how to say, interest and trust of the public.

Members are, and these are the associate, uh, commissioners, are retired Northern Cape Justice Judge Frans Nyalegomu and Advocate Andrea Gabriel, Senior Counsel.

The core question that this commission exists to answer is whether or not there were active attempts within the SAPS, the police, or prosecutors, that being the NPA, not to investigate or prosecute TRC cases, and did any officials collude with such an effort? What must also be decided by this commission at the end of its work, which is the 18th of December, initially it was granted six months, but due to court cases that I will explain in the later part of this analysis, it's been extended similar to the Madlanga Commission.

This commission must decide in the end what the state should now do, including prosecutions, and whether victims and the family members of victims should receive constitutional damages for the undone work by the TRC.

We now stand at day ninety-five of hearings, and as of now, what is happening is that the commission is actively finalizing its last few group of names of people who they want to come and testify and give them perspective into government's role in seeing the fulfillment of these cases.

This, of course, existing within the context of if the conclusion of the Khampepe Commission's work is found to suggest something that the two former presidents or anyone else mentioned possibly in that report would want to disagree with or challenge, they would be able to do so and take the report on review.

Now, the importance of this commission is to understand the work that it is supposed to do.

We are learning in real time from the Madlanga Commission of Inquiry what happens when work that is supposed to be done, not just by the judiciary, but by law enforcement agencies, is left idle or is left to be influenced by government or state actors, that there is the room for impropriety to take place, an impropriety that does not serve in the best interests of justice.

The Khampepe Commission of Inquiry exists to assess whether or not such an occurrence took place with the Truth and Reconciliation Commission and its final recommendations.
