Lasting power of attorney

Right, let's get going.

When did you last look at a will or a lasting power of attorney and actually understand what it said and what it was trying to do? They're still written, particularly wills, in near Dickensian language, which makes them quite hard to decode sometimes.

And lasting powers of attorney come with limits that can catch people out and often do, such as what can an attorney give? What can they invest in? Can they set up a trust? What about business relief? What happens if the attorney loses capacity themselves? And we're going to answer all those questions today.

With pensions moving into the IHT net in April, a lot of existing wills are suddenly going to be out of date.

This makes it a good time to revisit clients' arrangements.

And as you were talking, I was reflecting, you know, I do Lasting Power of Attorney now as well as lots of the roles that I'm currently doing.

And interestingly, I've had those conversations with carers where it's been both the situations you've described.

So I've had carers, daughters or sons say, you know, I've tried to have this conversation with mum and dad, but they've blocked it down.

But equally, it's probably 50% of the time I have the parents, sort of the older clients that say, I've really wanted to do a lasting power of attorney, but every time I raise it with my daughter, she shuts me down.

And Catherine Mannix describes beautifully people being, you know, coming to her with saying, well, I know my loved one is dying, but I'm too scared because I don't want to upset them.

And then the person, the loved one is saying, I know I'm dying and I can't talk about it.

It sort of sums it up really, doesn't it?
