Britt, ICE detained the unnamed Venezuelan man in August of this year, but it has taken until Wednesday of this week for a judge to establish he was wrongfully detained.

The controversy in the arrest stemmed from the presence of an Ogden police officer who was coincidentally on scene for another call.

When the arrest began, both the Venezuelan man and the ICE agent asked the officer for help, calling into question the role, if any, local law enforcement plays when it comes to federal detainments.
