class action lawsuit against Biolab is being heard in federal court.

Early in that case, Biolab and parent company Kik asked a federal judge to dismiss the resident's request for medical monitoring.

The company argued that Georgia law doesn't allow someone to seek that kind of relief without a present physical injury.

But that presented the federal judge with a problem.
