And it takes things in a different direction from some of my critiques, which are like, why are we looking to define the right by looking to non-judicial bodies in the absence of any evidence they were actually interpreting their constitutional obligations? Like, why is the Kentucky State Legislature in 1872 and creating law that functionally serves as precedent for a court in 2026? That's always been one of my principal critiques because the current court doesn't defer, doesn't treat congressional enactments as essentially binding precedent when interpreting those enactments.

So my issue has been much more sort of mechanical as opposed to philosophical, I suppose you would say.

Similar to this is Bill No. 251 of the Kentucky Legislature, which reads, quote, It shall be unlawful for any person to fire or discharge at random any deadly weapon, whether said weapon be loaded or unloaded.

really that legislature must have had in view the damage done by weapons thought to be unloaded michigan has on its statute books the weight anti-treating law passed in eighteen ninety five which prohibits the purchase of liquor to be given to another as a treat and in south carolina private dispensaries became so obnoxious that a bill was introduced making it unlawful for a citizen of that state to wear hip pockets in his trousers, the minimum penalty being $150 and six months' imprisonment.

It's basically saying, "Give us money or we'll sue you." And, uh, the State of Vermont turned around and said, "Okay, fine.

We're gonna, uh, put a stop to this." And interestingly, I live in Kentucky, and thanks to a friend of mine, uh, who owns a company that got sued here locally as well, we decided to copy that law and run it through the Kentucky State Legislature, and it's already passed the Senate, and the House is looking at it, and hopefully we'll be the third state to pass similar legislation here pretty soon.
