They are correct.

Of the 24 landmark Warren Court decisions listed by the legal website Justia, none overturned an act of Congress.

If the Warren justices had a bone to pick with legislators, It was with the state and local ones upholding Jim Crow.

To be sure, overturning a federal law is rare during any era of the court.

The Missouri Supreme Court was emphatic about that, which means that in theory, the Democrats might win one more seat than they would have won it come November if HB1's lines were in effect.

Now, of course, this means using different district lines for the general election in November than were used in August during the primary election, which is suboptimal, as I write in a Justia column that, that posted on Labor Day.

But as I argued, I don't think it's proper to use lines in HB1 that have never had the force of law, because once the referendum petition was filed in December, that should have blocked HB1 from ever taking effect.

So just because those lines were wrongly used during the primary is no reason to have them wrongly used yet again in the general election.

But some of these bills purport to regulate federal officials as such.

And Vic has actually written several pieces, including on Justia, saying, those are going to raise some supremacy clause problems.

Where do states get off regulating federal officials as such? But these converse 1983 laws, if they're clean laws, they're not part of a larger legislative package.

They're not so much regulating the conduct of federal officials.

Is that really denying or abridging anyone's rights, or is it just conferring additional options on some people? That reasoning is what the Fifth Circuit relied on in upholding Texas's law.

And as I've written in commentary on Justia verdict and also in law reviews, including the Notre Dame Law Review in an article that the Fourth Circuit actually cited to, I think that baseline, that temporal baseline, are you taking away something that a group had before? I think that's the wrong baseline.

There's several reasons why.

First of all, it's accidental what that original baseline was.
