A
1:05AnitaHOST
And that false sense of security is exactly why we're dedicating this deep dive to our source material today.
A
1:11AnitaHOST
We're looking at a really detailed guide by Anita Hummel from Mondoro, and we are decoding Incoterms, which stands for International Commercial Terms.
S
1:20speaker_1UNKNOWN
Yeah.
S
1:20speaker_1UNKNOWN
It's an essential topic.
A
1:47AnitaHOST
Exactly.
A
1:48AnitaHOST
So to start, what are we even talking about here?
S
1:50speaker_1UNKNOWN
Well, the foundation to understand is that Incoterms are not just, um, random suggestions or industry slang.
A
1:56AnitaHOST
Right.
CEO: How Executive Orders are Reshaping Chemical Imports and Compliance with Noushin Shamsili of NUCO Logistics - Ep. 281
N
14:01Noushin ShamsiliGUEST
What does it mean? It means that they have to come up with criteria to make sure that the, uh, correct amount of bonding is in place for the US importer of the record versus foreign importer of the record.
N
14:18Noushin ShamsiliGUEST
A brief explanation, I think, here would help to understand that traditionally, when the shipments are purchased based on DDP, duty delivered, uh, paid Incoterms, the foreign manufacturer would, uh, sell the product, would arrange the, uh, ocean transportation, and once arrived in the US, through a representation of their company, that could have been just, uh, one person sitting at their home, uh, arrange the customs clearance through a, a customs broker, and then finally deliver it to the importer of the record.
N
15:01Noushin ShamsiliGUEST
Now, that is changing.
N
15:03Noushin ShamsiliGUEST
The administration is pushing hard to, uh, make sure that the foreign importer of record should have physical presence in the United States, and have asset, and should have assets, basically.

I'm particularly excited because When it comes to certain topics such as Incoterms, I know Arthur is definitely a go-to and we'll talk a little bit about that because of his credentials and his certifications that he has behind that.
L
1:08Lalo SolorzanoHOST
So thank you, Arthur.
L
1:09Lalo SolorzanoHOST
Welcome to our series here of

Exactly.
L
5:19Lalo SolorzanoHOST
So for this week, do you think you want to iterate on that one book? So,
A
5:25Arthur O'MearaGUEST
you know, Incoterms is a passion of mine.
A
5:29Arthur O'MearaGUEST
And when I teach it, let's be honest, everything we do here, Incoterms, tariff classification, valuation, country of origin, quantity, export control, license determination, classification on the commerce control list or the United States munitions list, et cetera, et cetera, et cetera.
Ep. 81: "The Now Layer: Real-Time State Meets Documented Context"
C
15:33Caspar JansHOST
At the moment that AI needs to optimize that, because that's, that's a humongous context model.
C
15:42Caspar JansHOST
That means that the, the AI needs to be capable of going not only into a context model that says, "Yeah, but if you, if you have this sales order, then it, it's connected to a shipment and delivery, it's connected to Incoterms, it's connected to the agreements that we have with the customer, the contracts, uh, and it needs to be connected to the billing part." But it also needs to replicate that a hundred or a thousand times for all of the individual processes, and then aggregate it back into something that makes sense for the people that do the supply chain management.
C
16:15Caspar JansHOST
Because one, one of the biggest challenges...
C
16:17Caspar JansHOST
I've, I've, I've been a supply chain manager for a couple of years in my, in my career, and one of the biggest challenges was, is that on the highest level, the aggregated level, it looks all very plausible and understandable.
Podcast: finding clarity in EU’s CBAM ‘document dumps’
J
21:42John Carruthers-GreenHOST
Is that something they can do that would then remove the CBAM liability from them? Because are they still the reporting declarants? Is there still potentially that liability with them there later?
K
21:55Kieran McCannGUEST
Yeah, well, under the Incoterms DDP, all customs liabilities and CBAM liabilities will fall with the exporter.
K
22:06Kieran McCannGUEST
But for the exporter to actually be registered as an authorized CBAM declarant, in the importing country, they have to have a presence on the ground in that country, or they need to appoint somebody to act as the authorised decorant on their behalf.
K
22:22Kieran McCannGUEST
So Winko terms is important.
Ep #101 Revenge of the CIF
L
15:29Luke ZadkovichHOST
And then they changed to a SIF trade.
L
15:32Luke ZadkovichHOST
And so the Incoterms went from DES to SIF.
L
15:35Luke ZadkovichHOST
And from that change, from SIF, from DES to SIF, the delivery dates obligation, as stated at least, didn't change.
L
15:44Luke ZadkovichHOST
The question is, when the parties agreed to go from DES to SIF, did they actually change the nature of that delivery obligation to be one of absolute times of the essence? Or was it now only indicative of as set out in the BPG2Cs for sales.
43 MINS LATER
L
58:58Luke ZadkovichHOST
And that's the regime you're in.
L
59:03Luke ZadkovichHOST
Everything else has to fit within that regime.
L
59:05Luke ZadkovichHOST
And it's not, you know, we've talked a lot about I have talked to Lisa a lot about the specific provision providing over the general, but what we didn't go into in detail, and I think this would be the other side of the debate, is to focus on this isn't just a switch of Incoterms.
L
59:24Luke ZadkovichHOST
It's a switch of the fundamental nature of delivery here.
