And among all of the legal issues that appear in Judge Hellerstein's opinion, the most important one, the most significant one for Trump's ongoing appeals is a finding on page 31 of this opinion where Judge Hellerstein said the trial evidence shows no relationship to official acts.

Judge Hellerstein says that you spoke to Hope Hicks and you're saying that because Hope Hicks was Was, you know, your White House aide, her testimony couldn't have been used against you at your trial? Well, too bad.

You were discussing unofficial acts.

You were discussing the disguising of these hush money payments to Stormy Daniels.

some sort of ruling about the nature of the evidence used against him.

Were his tweets at the time commenting on the Stormy Daniels scandal an official act of his presidency, that this was a distraction from what he was doing in the Oval Office? Or was this Donald Trump dealing with a private scandal? Hellerstein found it was the latter.

Was his conversation with Hope Hicks a important feat of messaging about something that was a distraction from his work in the White House? No, these were unofficial acts in Hellerstein's findings.

So On the one level, this is a low stakes legal battle in the sense that it was simply about where these appeals would happen.

It must have been a presidential meeting.

I spoke to Hope Hicks, my press secretary, about it.

It must have made it presidential, right? No, no.

You can conduct a underhanded personal event having nothing to do with your presidency while you're the president of the United States.

Um, uh, but even if that's the case, you know, you can't have evidence against a president, uh, of his official acts that's used to convict him for that unofficial conduct.

Um, and so there was this question, uh, after the trial and after the immunity decision of, of what's going to happen to this conviction because they, the evidence in the trial included things like a discussion between Trump and Hope Hicks in the White House about how to handle, um, some of the news reporting about the Stormy Daniels matter.

There were tweets that Trump made about Michael Cohen when he was president on his official Twitter account.
