Officials are trying to find out where the Missouri man got swine flu.

When convicted killer Gary Gilmore was last heard from, he still wanted to go before a Utah firing squad rather than spend life in prison.

But ABC's Tom Schell in Salt Lake City says Gilmore's attorney is appealing to the Utah Supreme Court in another matter.

As Gary Gilmore's defense attorney presses for more access to his client, the Utah Supreme Court is being asked to order prison officials to allow the attorney, Dennis Boaz, closer contact with Gilmore.

Under present arrangements, Gilmore and Boaz are in separate rooms and talk by telephone.

An aide to the Utah Supreme Court told me one question the court will be considering is this.
