Or, or I'm sorry, within the ATF on how to handle these situations.
R
8:22Ryan PettyGUEST
And third, and you ran into this in Pennsylvania, we, we deal with this here in Florida too, we do our background checks through the Florida Department of Law Enforcement.
R
8:31Ryan PettyGUEST
It sounds like Pennsylvania has something similar.
R
8:34Ryan PettyGUEST
The ATF needs to train the state agencies and make sure they're updating their records on a, on a regular basis because, you know, it's been more than like 48 hours since Tate, uh, received his pardon, and my question, uh, you know, Mark, when you and I talked, my question was, why hadn't Pennsylvania updated their records?
M
8:54Mark WaltersHOST
That's, that's a perfectly legitimate question, and I think bureaucratically, that's gonna be the toughest obstacle to overcome, Jarrod.
J
9:01Jared YanisGUEST
Yeah.
M
9:01Mark WaltersHOST
Because once the FBI makes the change at the federal level, that fixes the problem, but it doesn't fix the problem when you're dealing with the Florida Department of Law Enforcement, or as you said, referred to as FDLE or, uh, PICS here, it's the same thing, Justin.
M
9:16Mark WaltersHOST
Would additional guidance matter, or does it have to come from a bureaucratic fix? Is guidance even gonna help?

K
2:37Kenneth KiciaGUEST
So the first thing is to reassure our constituents that our data resides exclusively in the United States.
K
2:44Kenneth KiciaGUEST
There's no backup or replication of data outside of the U.S. We use only U.S. developed AI models like Azure Gov AI, AI Foundry, OpenAI model, ChatGPT 4.0. And environments are managed by U.S. persons with background checks, procedures data by FDLE.
K
3:03Kenneth KiciaGUEST
And so those are kind of the foundation for the AI tools that we're using.
K
3:08Kenneth KiciaGUEST
We use generative AI for five different use cases, chat, document retrieval, data quality analysis, productivity and enhanced decision making.

D
7:43Denis QuintanaGUEST
What does that mean? Expunged means that there's a process to get it expunged.
D
7:50Denis QuintanaGUEST
But if you're successful in getting it expunged, it means that ultimately the local judge is going to issue an order that says clerk of the court, Orlando Police Department, Florida Department of Law Enforcement, the National Crime Information Computer, all of these databases, eliminate and obliterate any record of Dennis's criminal offense so that if anybody does a search in the future, there won't be any evidence of it.
D
8:18Denis QuintanaGUEST
That's an expungement.
D
8:20Denis QuintanaGUEST
How is that different from a sealing? Well, a sealing, S-E-A-L, not sealing like a roof, but to get something sealed, right? A sealing means, okay, Dennis wasn't convicted.
S
10:33Shameika RhymesHOST
They've just been saying, oh, after a certain amount of time, then it can get expunged and I don't have to do anything.
S
10:39Shameika RhymesHOST
It just falls off the record, which obviously it sounds like that is not true.
D
10:44Denis QuintanaGUEST
it's first of all nothing happens automatically right so in order to get a case sealed or expunged you have to affirmatively file a petition to have it sealed or expunged the process in florida is first you have to show that you're eligible so in order to show you're eligible you have to fill out an application the application goes to the florida department of law enforcement they're the ones that keep all the records in the database the florida crime information computer But what makes you eligible? You have to get certified copies of the court disposition.
D
11:18Denis QuintanaGUEST
Whatever happened in court, whatever the sentence was, or if it was dismissed, you need to get a certified copy.
