So if the local government representative determines the town lacks resources, capacity, or staffing to review an application, they have 60 days after the receipt request a de novo adjudication by the Energy Facility Siting Board.

So the EFSB will be the body that will be reviewing projects larger than 25 megawatts for energy generation and larger than 100 megawatt hours for energy storage and the municipality does to opt into that process if it finds that an application falling below those thresholds would cause significant staff or board capacity constraints and that that's kind of the safe hold that you have during that 60 day period.

If the town were interested in pursuing this there are funds allocated to opt into an Interceptor status from the municipal side to still take part in the application process But not be in the driver's seat so to speak for evaluating the the proposal itself

um on page 34 there a new definition has been added for small wind facilities specifically to call out wind facilities less than 25 megawatts of energy generation capacity and the reason this definition has been added is that subset of projects qualifies for the consolidated permit process so we're just wanting to make sure folks are aware that IF THEY DO HAVE AN INSTANCE WHERE IT EXCEEDS THAT CAPACITY, IT WOULD NOT QUALIFY FOR THAT PERMITTING PROCESS AND WOULD ESSENTIALLY FOR THE SMALL PROJECTS, THEY HAVE THE OPTION TO STILL OPT INTO LOCAL REGULATIONS OR IF THEY FIND IT FAVORABLE TO DO SO, THEY CAN PURSUE A CONSOLIDATED PERMIT PROCESS.
