All right.

Then it goes through why jurisdiction is proper, because they all had activities going on within the state of New York, etc., etc., etc.

Now, as you can see, ladies and gentlemen, like I said, I don't know if these young men, I mean, this is Ivy League school, going to expensive school.

Maybe their parents have money, but guess what? The parents aren't responsible for these...

men they're over 18 years of age probably have no money if they had any assets they're probably in a trust they can't be touched that's why the plaintiff's attorneys goes after the school and then of course the dram shop violation against mooney's where they're saying that she was given alcohol as well you know let's not forget the sorority house now let's get into some that's the plaintiff's side from the civil case always two sides of the story The district attorney put out a statement the other day.

Now, remember, this attorney has now been replaced because the governor lost trust and confidence in the district attorney.

A representative from the Tri Delta executive office did not respond to a request for comment.

The plaintiff brings claims against Mooney's Bar and Nightclub, alleging that the bar and its employees violated New York's Dram Shop Act, which can hold alcohol vendors liable in certain circumstances when they knowingly serve persons who are underage.

Mooney's denied the allegation of negligence in violation of New York's Dram Shop Act.

In a statement sent to The Sun after publication, a Mooney's representative wrote that on October 19th, 2024, Mooney's had a contract in place with Tri Delta as it hosted the sorority's private event.

Per the contract, Mooney's marked the hands of underage guests, provided wristbands to those over 21 years old, and, quote, "No alcohol was served to guests who had marks on their hands," according to the representative.

And then there are counts included in here against the individual fraternity defendants for their actual sexual assault and rape.

And then against Mooney's Bar and Nightclub, the bar that I told you about a couple of minutes ago, for violation of New York's Dram Shop Act, as well as other theories of negligence, Dram Shop Act is this idea that you knew or should have known that you should not be giving alcohol to somebody below the age of 21 who's a minor.

And then also, if they look like they are inebriated, you cannot continue to give them alcohol, which would then heighten their inebriation or their inability to have their normal faculties.

So...

Count seven should be intentional infliction of emotional distress against all the individual defendants.

Count eight, negligent infliction of emotional distress.

Count nine, violation of New York's Dram Shop Act against Moonies for again serving her alcohol even though she was visibly intoxicated and she was a minor.

She demands a jury trial, compensatory damages, punitive damages, fees and costs as well.

I, I would, I hope that you know the law, but as you know, the fact that you own a bar, or y- not you, but the fact that people are bar owners don't, doesn't mean that they are beyond questioning when someone accuses them of over-serving somebody.

You are exactly the people who the Dram Shop Act was meant to guard against, is somebody who serves liquor.

You, y'all have to serve liquor in a certain way that's responsible, that doesn't lead to catastrophe.
