All right, Judge Boardman Roger, District of Maryland, has enjoined, no surprise here, that new executive order that in the face of a Supreme Court decision that says birthright citizenship means birthright citizenship, purports to say that birthright citizenship doesn't necessarily mean birthright citizenship.

Any surprises here?

um not really it's it is a very you know a month after the uh barbara decision um yeah this this new executive order came out and it sort of tries to nibble around the edges and say there are still some live issues here and it it tries to carve out some new exceptions.

This one is called CASA.

It's the one that We had that decision about universal injunctions earlier.

It comes out of the District of Maryland and the judge is Deborah Boardman.

There are certified classes in both, and in fact, nationwide classes, and they are identical.

Federal judge blocked Trump's second attempt to restrict birthright citizenship, ruling that his August executive order is, quote, "almost certainly unconstitutional." U.S.

District Judge Deborah Boardman accused the administration of adopting a distorted interpretation of the Supreme Court's June decision that struck down Trump's 2025 executive order that denied citizenship to children born to parents who were in the U.S. temporarily or unlawfully.

Quote, "No presidential executive order can undo what the Supreme Court has done," Boardman wrote.

Attorney General Todd Blanche maintained that the administration will continue fighting the case and, quote, "If we have to go back to the Supreme Court, we will." So in other words, what, what they're doing is they're fucking that chicken, aren't they? [upbeat music]

Now the Trump administration has gone back with another version of this, and they've narrowed it.

The judge who gave the stay on Wednesday, named Judge Deborah Boardman, said that as it reads now, the Trump's executive order, quote, is almost certainly unconstitutional.

Well, it depends on what part of it.

We begin this morning with domestic news, starting with Biden versus Trump and who gets to be an American.

Fox News is reporting that Joe Biden's judge, Ms. Deborah Boardman, has again ruled against President Trump and his latest executive order trying to redefine or limit birthright citizenship.

We'll recall that the Supreme Court had blocked Trump's first executive order on this matter in a case that is called Trump versus Barbara.

But then the president and his team refined, reissued that executive order back in early August, trying to stop automatic citizenship from certain workers at embassies, babies of people who belong to foreign terror groups like Al Qaeda, and also birth tourists who use surrogates or intentionally try to cheat their way to baby citizenship.

After that August executive order, Democrats worked with several petitioners to sue regarding that updated order, including a couple of Mexican and Venezuelan women who said that their babies might be labeled as terrorists by the White House.

This Biden judge decided that that argument was pretty compelling and then blocked Trump's latest executive order.

The White House is now expected to appeal that ruling to the Supreme Court, which Democrats honestly was the plan all along.

This is a test and a probe of how far the president can go to tighten up birthright citizenship rules based on executive powers alone.
