again yeah clearly it's something we're looking looking at a lot of those uh those cars come with quite lengthy warranties but again just looking and picking through the detail of of those and it'll be really interesting to see whether how robust those warranties are if those if those vehicles haven't been let's say uh inspected you know checked by uh in accordance with the uh the manufacturer's guidelines you know how many of those are uphold in the in the event of a claim so i think time will tell time will tell
James BaggottHOST
34:16
yeah be interesting to see what happens there and just this will probably lead us quite nicely onto the stories in a moment but it's another thing that we've been talking about quite a lot with guests on the podcast there's the consumer rights act i mean you know as somebody who was has worked in the most trade at dealer level someone who's now working on the on the warranty side do you think the consumer rights act as it stands is is fit for purpose for the for the used car market
Leo NelsonGUEST
34:43
Look, as a principle, I think it's very important, making sure there is some legislation there to prevent rogue traders and dealers.
Leo NelsonGUEST
34:52
I think from that point of view, it provides a level of protection for consumers.

Step two, issue unsigned tenancy documents first.
Nick BowerHOST
7:04
Before asking the guarantor to sign, you must email them an unsigned copy of the tenancy agreements under the Consumer Rights Act 2015.
Nick BowerHOST
7:13
Terms must be transparent.
Nick BowerHOST
7:15
If a guarantor claims in court that they were never shown The underlying tenancy terms, the guarantee can be voided.

But the instant a client pays your invoice, a formal contractual standard is established.

58:29
The sources dive deeply into this transition, heavily referencing frameworks like the UK's Consumer Rights Act 2015.
Paul R. GloriaHOST

Which dictates that any service supplied to a consumer must be performed with reasonable care and skill.

58:40
Yeah.
Joel CombesGUEST

Well we run a legal helpline and casework service for the motor trade and purely the motor trade so over time we've been now doing it for 25 years we've become the largest UK supplier of legal support to the motor trade which means we have the biggest amount of data on the cases going through which gives us an interesting view on things that happen.
Joel CombesGUEST
5:14
I know you've had a lot of chat on your show about the Consumer Rights Act and it's not fit for purpose.
Joel CombesGUEST
5:22
This is something we deal with.
Joel CombesGUEST
5:23
You know, 80% of the cases we deal with are Consumer Rights Act.
Joel CombesGUEST
5:28
We were writing about it 13 years ago before it came out.
Joel CombesGUEST
5:33
It came out 11 years ago.
Jon ReayHOST
6:49
But, yeah, I would say that's a decent overview there, Joel.
Jon ReayHOST
6:53
Yeah.
Helen GoddardHOST
4:24
He wrote back to us, while I understand you need to investigate the courier's handling of the package.
Helen GoddardHOST
4:30
Under the Consumer Rights Act of 2015, my contract...
Helen GoddardHOST
4:33
Oh, someone's been on chat, GKT.
Helen GoddardHOST
4:35
Yeah, my contract is directly with you and not with Daypay Day.
KlausHOST

And it's not the first, this is not the first way he behaves, right? Has to remember, if you misdescribe vehicles, and if somebody pays you deposit, it's, by consumer rights, you have to refund deposit, you know, because the cars are not as described.
KlausHOST
21:13
you know, Sales and Goods Act, Consumer Rights Act 2015, you know, if the vehicle is misdescribed, you know, you have to refund the deposits, and if you don't, the people will take you to court, and they will win the court, because you're withholding deposit, because they entered in a sales agreement by faith the vehicle is as described, and this is, this situation where when I inspected this car for the customer, you refused, right, to refund.
KlausHOST
21:46
Also, I don't know the end of the story, whether you refunded or not, but I just, what I can see by the reviews, right? You can see clearly, that's 21st of July.
KlausHOST
21:56
We just spoke about deposits, you know? They asked 500 pound deposit, right? And they told, deposit is non-refundable and it turned out when I bought a car at least two thousand of damage on the vehicle which wasn't sold about you know so if you go through these reviews you can clearly see the pattern of what this person is doing right it's not about how good your reviews are right or even how bad they are but what people are mentioning you know and that just reflects so i would never buy a car from this guy never it's just that's my opinion based on what i can read about you know um if if you compare even let's say just take anyone let's just take car exam right if you're going to cards and reviews that's what he's left right our ratio on a bad reviews is 4% so probably another 2% are sellers like Hussein right who left bad reviews you know on Carvix ML and because our most of the reviews are verified, you know? As you can see, wherever you have a bad review, it's not verified person, you know? And when you read about these reviews, everyone will have a bad reviews, you know? Like there's some issues, somebody was complaining about some sort of report, right? Which is fine, right? But there's only 4%.
James BaggottHOST
46:59
I just...
James BaggottHOST
47:00
I, I agree with everybody we've had on the podcast who've said the Consumer Rights Act for used car dealers, especially in that older, older market, is not fit for purpose.
Peter SmythGUEST
47:10
Correct.
James BaggottHOST
47:10
It really isn't.
James BaggottHOST
47:47
They say, "Our consumer rights legislation helps people buy with confidence while providing clear protections when things go wrong." The problem is they don't understand the used car market.
Jon ReayHOST
47:57
No.
Jon ReayHOST
47:57
I think the, the only viable way for something as complicated as what the kind of modern cars we have now, the only viable way to make that work under the current Consumer Rights Act is to compel manufacturers to put a much longer warranty on all the complicated bits or make it easier to repair them.
Jon ReayHOST
48:12
You know, can you imagine having a, like the Audi I'm driving around at the minute, James.
