The Code of Practice is a set of agreed standards that have been developed by community radio stations across Australia.

They reflect the unique principles of community broadcasting and guide stations in a whole range of activities, including complaints handling and Australian music content.

From what I understand, for example, in January this year, there was this signature task force set up.

There are companies, general public service companies, who signed the code of practice.

The code of practice is this voluntary tool that companies can use to comply with the EU Act, General Procedure Rules.

And these companies that signed the code of practice, they have gotten together in the same room with regulators and have had dialogues with them from January already based on the information that I have.

So that already has happened, that one we have information about, but in terms of any concrete things that have been done, we don't have any information.

Second of August, when these powers were given to the AI office, there was an announcement by the European Commission that these enforcement powers have kicked in and these are things that are possible to do, including, for example, fines, as we talked and so on.

And, you know, Risa, you've touched upon this, but, you know, just to put it out there, does Europe's rulebook towards AI, does it have enough flexibility to become everyone's rulebook? Or is it just, you know, compliant within the 27 European countries?

Yeah, that's an interesting question.

So it's a huge area, which we have to squeeze in here, whatever, 45 or 50 minutes, which is going to be hard to do.

I suppose to start off, Breach, we'll do the science bit as always because you're worth it and we'll go into the code of practice and our remote work legislation and just do that as the foundation.

So run through the Work-Life Balance and Miscellaneous Provisions Act 2023, which is the big one here really, isn't it?

Yes, it is.

They can also deny it and can't actually be challenged on that.

But what they can be challenged on is what you've gone through at their breach.

Now, the other thing breach as well, which is interesting just to avoid confusion, is there was a lot of talk about about consultation at the end of 2025 with regards to changes to the Code of Practice and the Work-Life Balance and Miscellaneous Provisions Act, which kind of nothing really came from that.

So just to update people on this, because I know we were watching it and you were following it very closely.

So this is kind of tying into the declare your AI stuff that I covered a little while ago, a few minutes ago.

Today we're going to talk about elimination and that it has its own hierarchy controls and the way that people think about it when they're going through the elimination option.

But I thought what we'd do is we'd go through what people traditionally think of the hierarchy controls from the Code of Practice, how it also relates to safety and design and then the hierarchy controls in the WHS legislation, but then go to the elimination option.

Yeah, that's right.

And the reason why I talk about the hierarchy in the elimination option, from a criticality viewpoint, that's where you always want to start.

So what I thought I'd do is just summarise what the code of practice for OHS hierarchy control roughly is with a simple example.

So, I mean, most people remember we've got the elimination option, then you've got sort of substitution, isolation, engineering controls, then you've got admin and then PPE.

That's the normal way of thinking about it.

We probably cover slightly different activities to the Scouts, although there is some crossovers.

So that makes it the most widely applicable part of the AI Act.

So would you say therefore that the issuing of these guidelines in this particular instance was and necessary process that the Commission had to get through to reach to these objectives? And where do you see that the guidelines sit alongside the code of practice for labeling AI-generated content or AI-manipulated content that had previously also been issued?

So, it's a good question, our questions.

I would call Article 50 one of the AI Act's broadest horizontal provisions.

When you were saying how rulemaking will evolve and take place, I was also reminiscing about your previous work where you talked about how institutions actually can shape digital regulation more broadly.

So how would you contrast that work with how the European Commission has crystallized these guidelines into practice and into reality?

I think my point of comparison, starting with copyright law and platform regulation and within the IAC, similar process of the GPA, Code of Practice and their guidelines there.

Well, I think against that background, what strikes me a lot here or more is how operational the Article 50 guidelines are.

for political fund ballots and for merger ballots, with, more importantly, recognition and de-recognition ballots due to follow next year.

A new statutory code of practice on electronic and workplace balloting came into force the same day, 25th of August.

My headline view? It'll change behaviour a bit.
