Brady disclosure

What's up, everyone, and welcome back to the program.

So there's been a lot of talk about the Brady disclosure and the fact that there is an investigation, obviously, into one of the police officers who was investigating the murders in Moscow.

So I thought it would be time for us, the court filing surrounding this notice of a Brady disclosure.

So let's get right to it.

Case number CR 29-22-2805.

Notice of Brady Disclosure and Request for Protective Order.

State of Idaho Plaintiff vs. Brian Christopher Kohlberger Defendant.

Comes now, the state of Idaho, by and through the Latah County Prosecuting Attorney's Office, and respectfully gives notice to court and counsel that the state has become aware of potential Brady-Gilio material related to one of the officers involved in the above-referenced case.

Yesterday, we were talking about the disclosure of possible Giglio/Brady material by the prosecution and how it might or might not affect the case.

Well, we're getting a little more information about it as some of the experts out there start to weigh in.

So today, we have an article from Fox News dealing with this and talking about the likelihood of this Brady/Giglio disclosure looming large.

That's gonna give all kinds of ammunition to the defense.

But I don't think that's what happened here.

Brady material is information that could potentially prove a defendant's innocence, experts tell Fox News.

Giglio material is damaging to the integrity of a witness, in this case, one of the officers involved in the investigation.

I like that.

So we have some expert or sorry, some evidentiary privilege issues and confidential Brady material, pitches material.

The Johnson case is worth taking a look at.

It was an employment law case.

For those of you in the criminal context, the Schneider case, reached an issue of first impression.

The court used the pitches procedures.

They said pitches procedures are appropriate when determining whether Brady material is discoverable.

But the trial court erred in following just the pitches approach of giving contact information, names, instead of full Brady material.
