Our position is, Judge, and I respect that, is that in our particular language, there was nothing about the plea agreement, so I maintain that it should not be a preclusion from you inquiring.

The second prong under ANDIS would be the issue about whether it was knowing and voluntary, and that's where we get into the issue about the claim of ineffective assistance of counsel.

Because if an ineffective assistance of counsel claim targets the actual plea itself, and he claimed that he was ineffective, I was ineffective, that he didn't know what he was doing at the time, and I know Judge Brazel considered that, but I think that is another reason why that plea agreement should not be enforceable.

And last but not least is what everybody is trying to do, any appellate court anywhere in the United States when you're dealing with a defendant and their rights, you're trying to prevent the miscarriage of justice.

this, this, uh, whole science of behavior, which I didn't even know existed as an area of science, uh, fascinated me.

And I loved the way in which I could work with my dog in my living room with some, you know, string cheese and [laughs] an Andis clicker and, and kind of had this, um, experimental lab, if you will, where I could, could learn about the science of behavior and figure out how operant conditioning worked and classical conditioning worked, and in doing so, really bond with, you know, my, my little furry best friend.
