There was one study, and this came up in the trial.
Frank DeVitoHOST
30:17
I'm curious to actually get a hold of the primary source, but the Thomas More Society lawyers argued this in their closing arguments.
Frank DeVitoHOST
30:25
It's in the brief that There was one study cited by the California Attorney General linking like high dose progesterone to some hemorrhaging problem.
Frank DeVitoHOST
30:34
I have a friend who's a doctor and the medical director of a pro-life pregnancy center who was pouring through these arguments and is now looking for that primary source because it seems from Thomas More Society's arguments that those those results were pretty intensely misrepresented.
Frank DeVitoHOST
30:51
which would track with what I've heard.
Frank DeVitoHOST
30:53
And again, I have five kids.
Frank DeVitoHOST
31:57
So if California prevails, well, first of all, I think this will go up on appeal pretty quickly, but this would certainly create a chilling effect, right? And cause other pro-life pregnancy centers to say, I don't know that we want to offer abortion pill reversal because we don't really want to be bankrupted by an aggressive attorney general.
Frank DeVitoHOST
32:16
So I'm particularly thankful to...

Uh, the, the, the people who, uh, manufacture cases to take before our most puissant, dread sovereign Supreme Catholic Majesties, uh, leading to holdings of, uh, deeply held religious beliefs and, uh, um, uh, religious liberty.
Roxanne KincaidHOST
46:04
Sit, Liberty.
Jeff TiberiiHOST
4:58
Let me, uh, okay, there's ignorance, there's, uh, uh, transphobia, there are people who don't want their, uh, kids in this classroom, a- and, and now what? Like, what are, what are they asking for? What is, I guess, at the crux of this quote unquote "debate"?
Liz SchlemmerCORRESPONDENT
5:12
So what's happened more recently is that some of these parents, uh, while they've been asking to opt their kids out of the class, say they haven't been allowed to, and they've engaged with attorneys from the Thomas More Society, who sent a letter to the school district saying, "We're giving you until the end of September to meet our request, or we intend to file a lawsuit."
Jeff TiberiiHOST
5:36
Okay.
Jeff TiberiiHOST
5:37

And then one of the families that was raising a concern about this transgender teacher, they were doxxed online and received a bunch of profane texts from people in the school district.
Kyle NazarethHOST
16:28

Kyle NazarethHOST
16:34
And they sent the school district a letter on September 15th demanding that it grant the parents some religious accommodations, right? Like for the ability of the children to opt out of any class taught by the transgender teacher, that no student's going to be disciplined for using his actual real pronouns, right, the male pronouns for the male teacher, and that the gender identity and sexuality would not be discussed in advance in the classroom without parental notice, and that parents should be able to opt their students out of those kinds of discussions.
Kyle NazarethHOST
17:06
So getting into the kind of the legal analysis in the demand letter, it opens by saying that the parents, and this is a very important distinction, that the parents are not challenging the teacher's hiring and they're not asking the teacher get fired by the school district, right? They discussed the Bostock versus Clayton County case where the Supreme Court discussed and analyzed Title VII, right? The federal law banning employment discrimination, right? And the holding was that it does protect transgender employees, or one of the holdings that was mentioned.
Kyle NazarethHOST
17:38
And the letter from Thomas More Society concedes this and that the school had to follow that law in hiring.
Kyle NazarethHOST
17:44
But they do make an important distinction that Bostock governs how the school treats its employees.
Kyle NazarethHOST
17:51
Now, what the parents are objecting to are trying not to discuss the teacher's private life in the classroom.
Andrew KlosterGUEST
