But at the end of the day, I'm tired of Congress, quote unquote, taking a look.

How about some action? Linda Lacewell, superintendent of the New York Department of Financial Services, recently wrote in Law 360 that the reports filed to the federal government by banks about suspicious financial activity are frequently riddled with the names of anonymous shell companies that make it practically impossible to determine the identity of the perpetrator.

It basically negates all of the safeguards.

If you don't know who's in control of the company, how can you follow the money? How can you be sure that that money isn't being used to, say, fund a sex trafficking operation? You can't be sure.

I want to start by giving some background on where this program came from.

Synthetic identity fraud is now the largest global threat to lenders, anybody who extends credit, B2B transactional stuff, you don't know who you are dealing with anymore.

You have no idea.

It's just bizarre.

Next up, from Law 360, we have a settlement of FCPA case in the form of individuals who've agreed to pay $50 million back to prosecutors.

Hugo Jenkins and his son Mariano Jenkins made their first and likely only appearance to agree to the terms and conditions of the DPA and say that they were sorry they'd pay the money back.

Oops.

Does he know more than the other guys? I don't know, but he's Bill Gates.

Next up from Law360, the Corsa Cole former executive who was found guilty at trial, one Charles Hunter Hobson, has filed an appeal.

He's asked the court to toss his bribery conviction, calling it a miscarriage of justice.

Why? Because apparently...

So that article for anyone who wants to dig it up, and there are a few different takes on that.

There was an American Lawyer article, a Law 360 article, there was a write-up in Cranes or a write-up in Forbes, like different variants on that, but all of them get into the the numbers that basically are staggering.

You think of the NFL as this huge high-risk hiring problem, and it is.

And I'll go into that in a second.

And Mill told Ian Burns of Law 360 that the ruling is troubling, including because it seems to suggest, this is a quote, that the courts have no role in a thing called policy.

And I don't really know what that means, because all government action in a constitutional democracy, not just legislation, has to be compliant with With the charter, well, this mill policy is what's created when an elected government makes decisions that they're empowered by the Constitution to make based on their read of the evidence and the competing interests and priorities at play.

And again, judges simply decide whether or not they've complied with their legal obligations and followed the Constitution.
