If InterDigital adds its patents to the licensing platform, does its FRAND obligation mean that a license must be offered to the whole platform at a FRAND rate, or for a separate bilateral license just for the InterDigital patents? As regards the platform itself, Tesla have a right to challenge the fees they are being charged and to allow a court to consider whether the FRAND obligation is being met.

The justices then moved on to consider the jurisdiction issue, and began by noting that even though the number of UK patents on the platform is relatively small, in line with the 2021 Court of Appeal decision in Vestal Electronic and Access Advance, these proceedings concern what constitutes a FRAND licence for Interdigital's UK patents.
