At the same time, a growing number of Iowa cities and counties are adopting moratoriums to slow data center construction.

Beyond Nuclear, that's a Maryland group that supports renewable energy adoption, filed a petition October nineteenth challenging the Iowa Utility Commission's decision in June to grant NextEra a certificate of public convenience, use, and necessarily, uh, necessity authorizing the reboot of the plant.

The group said the members it represents in Iowa are adversely impacted by the agency action since NextEra is expected to generate and store an estimated fourteen metric tons of high-level radioactive waste on-site annually, adding to the six hundred eighty-eight metric tons of spent fuel it said are already being stored at the plant.

The group is seeking judicial review after the commission rejected its request in July to reconsider the restart.

Beyond Nuclear said the project won't benefit Iowa consumers given NextEra's agreement with Google to purchase most of its power and the tech giant's ability to resell power outside the state.

It also said that while the commission weighed the economic benefit of restarting Duane Arnold, it failed to look at the potential impact of four industrial solar projects near Duane Arnold the utility dropped when it moved to resume operations at the plant.

NextEra's Bolster said he believes NextEra will find a successful resolution to the lawsuit and will be able to continue to move forward.

The Utilities Commission declined to comment on Tuesday, referring to its July order in the case.
